Hereinafter referred to as “Prophood”, “the Company”, “we”, “us”, or “our”.
User herein referred to as “you”, “your”, or “Trader”.

1. Agreement to Terms

Welcome to Prophood. By accessing or using any of our services, platforms, or products (collectively, the “Services”), you affirm your acceptance of these Terms and Conditions (“Terms”). If you do not agree with these Terms, you must cease use of the Services immediately.

These Terms form a legally binding agreement between you and Prophood. You are urged to carefully review all provisions before using our Services. We may revise, update, or replace these Terms at any time at our sole discretion. Continued use of the Services following any changes will constitute your acceptance of the revised Terms.

2. User Eligibility & Obligations

By using our Services, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into a binding contract.
  • You are using the Services on your own behalf, or have authority to bind any legal entity you represent.
  • Your use of the Services complies with all applicable laws, regulations, and legal obligations.
  • You are not restricted or prohibited by any third-party agreement from entering into these Terms.

3. Grant of Limited Access

Prophood provides you with a limited, revocable, non-transferable, and non-exclusive license to access and utilize the Services as intended.

You may not:

  • Copy, reverse engineer, crawl, or scrape any portion of the Services without express written consent.
  • Claim any rights in Prophood’s trademarks, technology, software, or other proprietary materials.

All rights not expressly granted in these Terms are reserved by the Company.

4. Restricted Activities

You agree you will not engage in any of the following while using the Services:

  • Violate any applicable laws or regulations, including financial or trading industry standards.
  • Infringe upon any third-party intellectual property or privacy rights.
  • Use automated systems, bots, or scripts to interact with the Services.
  • Engage in any trading activities that fall under “Prohibited Trading” behavior, including but not limited to:
    • Exploiting platform latency or technical issues.
    • Arbitrage, front-running, or market manipulation.
    • Changing strategies between assessment and funded accounts inconsistently.
    • Holding single-share equity CFDs during earnings events.
    • Trading solely to benefit from price gaps.

Violations may result in account termination, forfeiture of fees, and cancellation of access to any funded accounts offered.

5. No Trading Advice or Education

Prophood does not provide financial, legal, or investment advice, nor does it specialize in trader education. Our Services are purely evaluative in nature for assessing trading performance.

Any available content or market data is for informational use only. You are solely responsible for conducting independent research or consulting a qualified advisor before engaging in trading. All trading carries inherent financial risk. Prior results do not guarantee future performance.

6. Account Registration & Security

To access our Services, you must complete the registration process by providing accurate personal information, including your name, contact details, and a secure password.

You agree that you will not:

  • Share your login details with any other person.
  • Create an account on behalf of someone else.
  • Operate multiple accounts at the same challenge level unless expressly approved in writing.

You bear full responsibility for securing your account credentials. Any suspected breach must be reported to us immediately.

7. Payments, Refunds & Right of Withdrawal

Prophood offers paid Services, including challenge accounts and platform access. Prices are subject to change without notice. All payments are non-refundable.

If deemed a “high-risk” customer, you may be required to verify your identity or payment method. Failure to do so within 24 hours may result in service cancellation without refund. Prophood bears no responsibility for issues arising from third-party processors or declined payment methods.

By agreeing to these Terms and Conditions, you specifically acknowledge and consent to NBS Tech Ltd. initiating service delivery prior to the expiration of any applicable statutory withdrawal period. You expressly agree that once performance begins, your right to withdrawal will be forfeited

8. Service Protocols & Notices

Prophood may provide specific rules, requirements, or procedural instructions relating to certain services, events, programs, or trading platforms. These service-specific guidelines will be communicated through our website or via email and are to be treated as integral parts of this Agreement.

Prophood does not guarantee employment, compensation, or access to future trading opportunities through the use of its Services.

9. Ownership of Intellectual Property

All intellectual property, including but not limited to trademarks, text, software, graphics, logos, and other proprietary content displayed or accessible through Prophood’s Services, is exclusively owned by NBS Tech Ltd. or its licensors.

You are strictly prohibited from copying, modifying, reproducing, republishing, distributing, displaying, creating derivative works from, or exploiting in any way any content without the Company’s express written consent.

Any unauthorized use of Prophood’s intellectual property will be prosecuted to the fullest extent permissible under applicable law.

10. Disclaimer of Warranties & Limitation of Liability

The Services are provided on an “as-is” and “as-available” basis. Prophood disclaims any and all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not guarantee uninterrupted access, error-free performance, or reliability of any platform or technology used in connection with the Services. Prophood bears no responsibility for:

  • Technical failures, downtime, or access disruptions.
  • Trading losses resulting from use of our Services, including but not limited to account closures or termination.
  • Any indirect, incidental, or consequential damages, even if the possibility of such damages has been advised.

In any claim or action, Prophood’s total liability will not exceed the lesser of USD $1,000 or the total amount you have paid to access the Services.

11. Indemnification & Defense

You agree to defend, indemnify, and hold harmless Prophood, its parent company (NBS Tech Ltd.), affiliates, employees, officers, and agents from and against any and all claims, damages, liabilities, losses, costs, or expenses (including attorney’s fees) arising from:

  • Your use or misuse of the Services;
  • Your breach of this Agreement;
  • Your violation of any third-party rights, including intellectual property or privacy rights; or
  • Your non-compliance with applicable laws or regulations.

This indemnification obligation survives the termination or expiration of this Agreement.

12. Arbitration Agreement

Any dispute arising out of this Agreement shall be resolved by Bulgarian courts.

13. Force Majeure

Prophood shall not be held liable for any delay or failure to perform its obligations under this Agreement due to causes beyond its reasonable control. Such events may include, but are not limited to, natural disasters, acts of war or terrorism, cyberattacks, labor disputes, governmental actions, widespread system failures, or other events classified as force majeure.

In the event of such circumstances, performance will be excused for the duration of the disruption.

14. Suspension & Termination of Access

This Agreement remains effective until terminated in accordance with the terms set forth herein. Either party may terminate this Agreement at any time by discontinuing use of the Services.

Prophood reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate your access to any or all Services, including in cases of suspected misuse, breach of these Terms, or unlawful activity. Termination will not entitle you to any refund or compensation.

15. Additional Legal Provisions

  • Survival of Terms: Any provisions that by their nature should survive termination—such as those regarding indemnification, intellectual property, and limitation of liability—shall continue in effect.
  • Severability: If any term of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Failure by Prophood to enforce any right or provision in this Agreement will not constitute a waiver of such right or provision unless acknowledged in a signed writing.
  • Entire Agreement: This Agreement represents the complete and exclusive understanding between you and Prophood regarding the use of the Services and supersedes any prior or contemporaneous communications or agreements.

16. No Reliance on Information

While Prophood endeavors to ensure that the information provided on its website or through its Services is accurate and up-to-date, no guarantee, representation, or warranty—express or implied—is made regarding the completeness, reliability, or accuracy of such content.

All information, data, opinions, analyses, or other materials made available are provided solely for general informational and personal use. They are subject to change at any time without notice. Nothing contained on the Prophood website or within its Services should be construed as financial, legal, tax, or professional advice.

You acknowledge that any decisions you make based on such information are made at your own risk. We strongly recommend seeking independent, qualified advice before making investment or trading decisions.
